The transposition of the ELD in England and Wales.....a critical assessment

VALERIE FOGLEMAN examines the new Environmental (Prevention and Remediation) Damage Regulations (2009) (EDR) and concludes that it is unlikely that the EDR "will achieve the fundamental principle of the ELD, that is, 'that an operator whose activity has caused the environmental damage or the imminent threat of such damage is to be held financially liable".
